DIVINE MINIMART KENYA TERMS AND CONDITIONS
SECTION 1: INTRODUCTION
These Terms of Use (the “Terms”) constitute a binding and enforceable legal contract between Divine Minimart and you. The purpose of these Terms is to govern the use of the divineminimart.co.ke website, service, content, and data. It is important that you read and understand these Terms before using the Service.
SECTION 2: SERVICE
The Service is an online platform that allows users to order items online via the website www.divineminimart.co.ke.
SECTION 3: ACCOUNT REGISTRATION

- If you register as a representative of a legal entity, you are authorized to do so by the company.
- You will immediately change your account information if you suspect any unauthorized use.

The information you submit as part of your registration remains your intellectual property. However, Divine Minimart may retain copies of all registration details.
SECTION 8: ORDERING
Divine Minimart will make all reasonable efforts to ensure the availability of the items ordered. However, the company reserves the right to cancel any order for any reason and will promptly notify you of such cancellation.
SECTION 9: PAYMENT
You will be required to make payment for your order before it is processed. Divine Minimart accepts various forms of payment and reserves the right to change the acceptable payment methods at any time.
SECTION 10: DELIVERY
Divine Minimart will make all reasonable efforts to deliver your order within the time frame specified. The company will not be liable for any delays in delivery beyond its control.
SECTION 11: RETURNS AND REFUNDS
You may return any defective or incorrect items within a reasonable time frame and receive a refund or replacement. Divine Minimart reserves the right to reject any returns that are not in accordance with the company’s return policy.
SECTION 12: WARRANTIES
Divine Minimart warrants that the items sold through the Service will be free from defects in materials and workmanship for a reasonable time frame. The company does not make any other warranties, express or implied, with respect to the items sold.

You acknowledge and agree that Divine Minimart shall not be responsible or liable for any damage, loss or liability of any kind that you may incur as a result of or in connection with your use of the Service. Divine Minimart shall not be responsible for any indirect, incidental, special, or consequential damages of any kind, including but not limited to lost profits or data.
SECTION 15: DISPUTE RESOLUTION
You agree that any dispute, claim or controversy arising out of or relating to these Terms or the use of the Service (collectively, “Disputes”) will be resolved through binding arbitration. Any arbitration between the parties shall be governed by the Arbitration Act, 1996 (Kenya).

These Terms shall be governed and interpreted in accordance with the laws of the Republic of Kenya, without giving effect to any principles of conflicts of law.
SECTION 17: CHANGES TO TERMS
Divine Minimart reserves the right to make changes to these Terms from time to time. Your continued use of the Service following any changes to these Terms will constitute your acceptance of such changes.
SECTION 19: ENTIRE AGREEMENT
These Terms, together with the Privacy Policy, constitutes the entire agreement between you and Divine Minimart regarding the use of the Service. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
SECTION 20: CHANGES TO TERMS
Divine Minimart reserves the right, in its sole discretion, to modify or replace these Terms at any time. Your continued use of the Service after any changes to these Terms constitutes your acceptance of the new Terms. If a revision is material, we will make reasonable efforts to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
